Abstract
This document focuses on examining the characteristics of employing public acquisition instruments by municipal authorities amid martial law. The objective of this investigation is to thoroughly examine the shift in public acquisition instruments utilized by local administrations during a period of martial law, aiming to adhere to the tenets of openness and responsibility. During the scholarly inquiry, general scientific methods of recognition were utilized, specifically including numerical and descriptive evaluation, review of publications, correlation, synthesis, and an organized perspective. The findings indicate that under martial law, public acquisition instruments have experienced a notable functional reshaping, mainly toward streamlining processes and broadening the options for entering into immediate agreements, which guaranteed an improvement in the effectiveness of administrative choices at the municipal level. Simultaneously, it was determined that such adaptability comes with a lowering of the degree of clarity and a lessening of oversight systems, which generates further graft hazards and boosts the reliance of purchasing outcomes on the structural ability of a specific group. The fundamental concepts of public procurement’s function as a governance tool are examined, emphasizing their importance during periods of crisis and dispute. The evolution of the regulations and legal structure for public buying in Ukraine amid martial law is explored, and key departures from the prior model are mentioned. The primary hazards and constraints that emerge during the wartime procurement procedure are pinpointed (diminished clarity, amplified judgment, graft dangers, structural unpredictability). The success of employing procurement instruments is examined using standards of efficiency, thrift, openness, and potency. Exemplary methods of municipal authorities in public purchasing during a state of war are ascertained. Reasoned suggestions have been formulated to enhance the public procurement mechanism, focused on achieving an equilibrium between adaptability and visibility. A theoretical framework for an adaptable public procurement structure for local authorities, appropriate for deployment in crisis and postwar settings, has been constructed.
