Abstract

The building of houses is one of the most regulated economic activities in Ukraine because it directly influences the right of citizens to own homes as stipulated in the constitution. The regulatory framework that oversees housing construction has remained outdated due to its reliance on Soviet era regulations, which create numerous conflicts within different regulatory documents. The complexity of permission procedures required by the existing regulatory framework has made the construction industry less appealing to potential investors. This article presents an organized examination of the existing regulatory framework that governs housing construction in Ukraine through its analysis of fundamental laws and subordinate legislation and national construction standards and program documents. The study focuses on legislative changes that occurred in 2023–2025 during a full-scale military conflict. The war directly influenced construction speed and state housing policy priorities, especially regarding the restoration of destroyed and damaged residential buildings. The research uses official State Statistics Service data to analyze housing commissioning trends. The researchers identified an irregular pattern of industry recovery that followed a wave-like course due to changing security conditions and macroeconomic factors. The study evaluated the working state support programs with special attention to the eOselia preferential mortgage lending program to determine its actual effect on different social groups’ access to housing. The Soviet Housing Code has been replaced by the Housing Policy Principles Law, which was passed at the beginning of 2026 as an individual law that creates a base for Ukrainian housing law to move towards European regulatory standards. The analysis has identified critical legal deficiencies together with the internal inconsistencies of the law, and it has provided specific recommendations to enhance the regulations towards establishing a transparent and predictable legal framework that would benefit all construction market participants.
