Abstract

The article focuses on the specifics of legal regulation of contractual relations in Ukraine during martial law. In the context of military actions that significantly impact the economic, legal, and social spheres, this research is relevant for ensuring the stability of contractual obligations, minimizing risks for the parties involved, and adapting the regulatory framework to crisis conditions. The objective of the study is to identify changes and peculiarities in the regulation of contractual relations during martial law in Ukraine. This includes analyzing imperative changes in contract law, examining the practice of applying force majeure provisions, and identifying problems that arise in legal enforcement. The study employed general scientific methods of cognition: analysis was used to study legal acts; synthesis was applied to combine individual aspects into a coherent picture; a systemic method was used to understand the interaction of legal norms in contractual regulation; and a comparative legal method was utilized to analyze changes in contract regulation before and after the introduction of martial law. The findings reveal that the introduction of martial law in Ukraine has led to significant imperative changes in the regulation of contractual relations. Specifically, contracts concluded after the onset of martial law include clearer provisions on force majeure, enabling the parties to account for risks and adjust contractual obligations to new conditions. By contrast, contracts concluded prior to martial law often lack such provisions, resulting in legal uncertainty. The practical significance of the study lies in the development of recommendations for improving the legal regulation of contractual relations under martial law, which will help reduce legal risks, enhance the stability of contractual obligations, and adapt judicial practice to crisis conditions.
