Abstract

The objective of this study lies in conducting a comprehensive analysis of the legal foundations governing the functioning of the unified system for recording information about damaged and destroyed property resulting from the armed aggression of the Russian Federation against Ukraine, identifying deficiencies in current legal regulation, and substantiating pathways for improving the national compensation mechanism within the context of international possibilities for war damage reparations. The methodological framework is grounded in the application of a systemic-structural method for examining the organizational-legal architecture of the state register of damaged property and its interaction with the international damage register, comparative legal analysis for juxtaposing Ukrainian legislation with international initiatives, particularly the “Riga Principles.” Additionally, a formal-juridical method has been employed for studying normative-legal acts regulating the functioning of the accounting system, and a functional approach for analyzing the roles of various categories of register users in the process of documenting and compensating damages. The research findings demonstrate that the unified accounting system established in Ukraine performs a critically important function of centralized collection of evidentiary foundations for implementing compensation programs and future international mechanisms. The structural elements of the system have been determined: operational management is assigned to the Ministry of Communities and Territories Development, while technical support is provided by a state enterprise within the management sphere of the Ministry of Digital Transformation. The objects of accounting, data validation procedures, and user categories with corresponding access rights have been identified. A key systemic problem has been revealed – the absence of technical and institutional integration between the national and international damage registers, which creates risks of data loss, information duplication, and complicates the formation of comprehensive damage dossiers for international compensation procedures. The study substantiates the necessity for improving legal regulation through institutional and technical integration of national and international registers, unification of norms regarding property classification and damage recording procedures. It has been demonstrated that the effective functioning of the unified accounting system depends upon coordination among state authorities, local government, and citizens, the development of a unified action algorithm, and ensuring balance between information publicity and personal data protection. The practical significance of the research lies in substantiating specific directions for improving the national compensation mechanism as a component of Ukraine’s post-war reconstruction.
