Abstract

The article demonstrates the study of the legal nature and features of the application of electronic contracts in the field of social services provided in territorial communities. The purpose of the study is to substantiate the essence of an electronic contract as an interdisciplinary legal institution and to identify ways to improve the legal regulation of relevant relations, taking into account European standards. In the course of the scientific study, general scientific and special legal methods were used, in particular: analysis and synthesis, comparative law method, formal legal method and systematic approach in the study of electronic contracts as a complex legal phenomenon. The information base of the study was scientific works of domestic and foreign authors, regulatory legal acts of the European Union and analytical materials. The article presents studies that show that electronic contracts are an effective means of digital governance, and will contribute to increasing the accessibility, transparency and efficiency of social services. It was determined that their legal nature is complex, cross-sectoral, as it includes elements of civil, administrative and information law, and in the field of social services, the principles of social security law are also important. It was substantiated that the improvement of the legal regulation of electronic contracts should be carried out by harmonizing domestic legislation with European Union law, unifying the procedures for their conclusion and execution, introducing modern electronic identification mechanisms and strengthening digital security standards, detailing the procedures for concluding contracts in electronic form in the field of social services, and increasing the digital literacy of the population. It was indicated that these measures will contribute to increasing the efficiency of the social service system, strengthening citizens' trust in public institutions and developing a modern digital model of management in the field of social services at the local level.
