Abstract
The article focuses on analyzing the mechanisms of international judicial and arbitration practice aimed at restoring Ukraine’s territorial integrity in the context of external aggression. The study aims to examine international legal instruments used to resolve territorial conflicts, as well as to assess their effectiveness and prospects for protecting Ukraine’s territorial integrity. The research employed general scientific methods of cognition: analysis and synthesis to generalize international practice; the comparative method to contrast approaches of different countries; the legal method to explore international law and court rulings; the historical method to study the development of practices; and the predictive method to evaluate the potential application of these mechanisms in the context of Ukraine. The results of the study demonstrate that mechanisms of international judicial and arbitration practice are crucial for restoring Ukraine’s territorial integrity, as they provide a legal framework to counter unlawful annexations and acts of aggression. Utilizing tools such as the International Court of Justice, the European Court of Human Rights, and arbitration tribunals enables Ukraine to systematically substantiate violations of international law by the Russian Federation. The research reveals that international judicial and arbitration practice showcases a multifaceted approach to resolving territorial conflicts, allowing the adaptation of other countries’ experiences to the Ukrainian context. The practical significance of the study lies in forming recommendations for utilizing international judicial and arbitration mechanisms as effective tools to safeguard Ukraine’s territorial integrity. It is proved that the use of multilateral legal mechanisms and international pressure creates a precedent that establishes the principle of territorial integrity as inviolable in the modern world order.
