LEGAL AND SOCIAL MECHANISMS FOR PROTECTING THE RIGHTS OF SERVICEMEN OF THE NATIONAL GUARD OF UKRAINE IN THE CONDITIONS OF THE RUSSIAN-UKRAINIAN WAR: INDIVIDUAL ASPECTS

Abstract

The article is devoted to the analysis of the legal aspects of protecting the rights of military personnel in wartime due to a number of factors of both national and international importance. It is determined that with the beginning of the full-scale invasion of the aggressor country into the territory of Ukraine in 2022, military personnel have become one of the key groups ensuring the territorial integrity, sovereignty and security of the state. Given the special nature of military service, military personnel face increased risks to life, health and social stability. In these conditions, ensuring their rights, both social and legal, becomes an important component of the stability of not only the army environment, but also society as a whole. The article emphasizes that the protection of the rights of military personnel is an integral part of compliance with international human rights standards, in particular in conditions of armed conflicts. Ukraine, as a state integrating into the European legal system, is obliged to ensure the rights of military personnel in accordance with international conventions and standards. This includes the right to social protection, a fair trial, protection from discrimination and the right to decent working conditions. Special attention is paid to the importance of ensuring the observance of the rights of military personnel through mechanisms of administrative and judicial protection, especially in conditions of martial law, when specific legal regimes operate. Some rights may be temporarily restricted, but this should not affect the fundamental rights of military personnel, such as the right to protection, to a fair trial, to social guarantees and dignity. It is noted that the study of the issues of protecting the rights of military personnel during wartime is important both from a scientific and theoretical point of view and for improving the legal framework of Ukraine.
